BANGLADESH: Labour rights activist arbitrarily detained and charged in three fabricated cases

The Asian Human Rights Commission (AHRC) has received information that the Detective Branch of the Dhaka Metropolitan Police illegally arrested a female labour rights activist named Ms. Moshrefa Mishu (46) on 14 December 2010. She has been arbitrarily detained in three fabricated criminal charges since her arrest. Ms. Moshrefa Mishu, is a leftist political activist and President of the Garment Workers Unity Forum (GWUF), a labor rights organization of the readymade garment factories of the country. She has been ill-treated and threatened with death or disappeared while in detention. The police have shown her arrested in three fabricated cases and remanded her for three days on different occasions. Mishu’s health condition has deteriorated as a result of ill-treatment and the subsequent denial of adequate medical treatment by politically-motivated doctors while in detention. Please intervene in this case by insisting the Government of Bangladesh ensure the required treatment and her release from the arbitrary detention.

Moshrefa Mishu,?illegally arrested and remanded.

I have known Moshrefa Mishu for the last 25 years.
Since the mid-1980s when the two of us had participated in long and intense discussions with other representatives of both large womens organisations and small womens groups, when we were trying to work out the possibility of forming a broad-based and united platform to collectively struggle and further the interests of women.
In the early hours of 14 December 2010, Mishu, who is the president of Garment Workers Unity Forum, was picked up from her house in Kola Bagan, Dhaka, by a contingent of a dozen or so in plainclothes (excepting one). They claimed to belong to the Detective Branch. They did not have an arrest warrant. Please remember that, as you read along.
She was produced in the Chief Metropolitan Magistrate’s (CMM) court after midday. Police sought a 10-day remand, the magistrate granted 2 days. She was accused of inciting garment workers at Kuril who were, according to news reports, demonstrating for payment of wages according to the new pay scale agreed upon by the government and factory-owners in August 2011. Demonstrating for, not against, and mind you, the government was a party to the agreement. Does it not strike you as strange that workers should have to demonstrate and picket, and to press for demands which are in effect, also the government’s demands? (workers had unwillingly agreed to the new wages because it fell far short of their demand for 5,000 taka as minimum wage, not the 3,000 taka which was agreed upon, which has been termed `poverty wages’). Workers at Kuril alleged that the management was not following the new wage board, it had added only 500 taka to each worker’s wage. Remember Kuril too, because I’ll come back to this later. Instead of imprisoning garment workers and their leaders, one would have thought government officials and factory-owners would be arrested for not complying with the wage board’s settlement.
She was remanded again, for 1 day, on December 17. The police added another allegation to their previous list, Mishu had been seen in the company of a Jamaat leader, travelling in his car. Where? When? Not surprisingly, the police could not substantiate their allegations, they could only insist that it needed to be investigated.
Mishu was produced in CMM court for the third time on December 19, afternoon. I was among a group of activists (university teachers, writers and a lawyer) who had gone there to express our moral support for Mishu. Only Sadia Arman among us was allowed to enter the courtroom as she’s a lawyer. She spoke to Mishu who sat in a bench at the back, with women police on either side. She was breathing with great difficulty, gasping for air as she spoke. She told Sadia that short of beating her, the DB police had tortured her in every possible manner. When Sadia asked her about the allegations against her, Mishu said, she had not been in Kuril but in Narsingdi, she had returned to Dhaka on 12th night, had been exhausted and had declined to attend programmes till December 16. She did not know why she had been arrested, they had not told her anything. Please note that the protests at Kuril occurred on 12th morning and that the allegations against her are not, according to the laws of the land, worthy of a remand.
We caught a glimpse of Mishu as she left the courtroom heavily surrounded by police. I watched a young policewoman flash a smile as she said confidently, oh, there’s nothing wrong with her. She’s fine. As we turned the corner of the courtroom and stood above on the landing, we watched Mishu climb down the stairs assisted by policewomen. We could clearly see that she was unable to walk by herself. I remembered an Indian feminist friend’s excitement when Sheikh Hasina appointed Sahara Khatun as the minister for home affairs. I had not been similarly excited. The proof of the pudding is in the eating, I thought.
Mishu’s breathing difficulties increased, she had to be hospitalised immediately. She was taken to the National Hospital first, where the doctors gave her a nebuliser and oxygen. Her back pain — from a spinal injury, the result of an attempt on her life several years ago which had been staged to appear as a road accident — increased tremendously. While she had entered the hospital sitting in a wheelchair, she had to be carried out on a stretcher. She was referred to the Post Graduate hospital where doctors provided further oxygen, she was then referred to the Dhaka Medical College Hospital. She lies in a `bed’ there, in a womens ward, hastily put together on the floor, as there were no vacant beds. Police surround her bed, both men and women, causing immense distress and embarassment to both Mishu and other patients, many of whom are confined to their bed and having to use bedpans for urinary and fecal discharges.
What induced this? Mishu was without medicine for more than 24 hours, the contingent who had gone to pick her up had only permitted her to change her clothes. Despite being a chronic asthma patient, she was forced to lie on the cold floor of the DB Headquarters with only a thin blanket to lie on, and a thin quilt as cover. By the time her sister was allowed to drop her medicine at DB Headquarters, she was already very ill,
the nebuliser was unable to provide any relief. She would have preferred a prison, she told her sister, as she would at least have some hours to herself, at the DB HQ she was interrogated at all odd hours, both during the day and at night.
What is equally worrying is that officials at the DB headquarters had told her sister before the court hearing on December 19, don’t worry, we’ll provide her with some hot water tomorrow so that she can take a bath. How could they have been so sure that their prayer for a remand would be granted? Is unseen pressure being applied by the government on the judicial process?
`First they asked for an end to slavery....'

A garment worker had explained to a Reuters correspondent that the reason for protesting was “because [the new wages are] too inadequate to make ends meet. We cannot submit to the [whims] of the government and factory owners.” Another had said, “We work to survive but….commodity prices are going up and we cannot even arrange basic needs with our meagre income. The 3,000 taka will be barely enough to buy food for my six-member family. How can I pay for medicines, the education of my children and other needs?” Nurul Kabir, the editor of this paper, in a talk show on a private TV channel the night Mishu was arrested, had said, he would like to give factory owners Tk 3,000 per month, for a period of three months, and would like to see how they managed to live on this meagre amount. I agree with him, I think such an exercise, conducted publicly, with daily updates, would prove to be tremendously educational.
Or, one could reverse what the Italian Marxist Antonio Gramsci, imprisoned from 1926-1937 (the prosecutor had said at his trial “for 20 years we must stop this brain from functioning”), had written to a family member, from prison: “tell me what the following categories of people eat in a week: a family of,

  1. day labourers
  2. sharecroppers
  3. small farmers who work their own land
  4. shepherds whose flocks are a full-time occupation
  5. craftsmen (cobblers or blacksmiths)

Questions: how many times do they eat meat in a week, and how much? Or alternatively, do they just go without? What do they use to make soup? How much oil or fat do they put in, how much pasta, how many vegetables etc.? How much corn do they grind, and how many loaves of bread do they buy? How much coffee or coffee substitute, how much sugar? How much milk for the children etc.?”
Reversing Gramsci’s questions would mean that I would like to know how many times a week the owners of garment and knitwear factories?those who receive orders, and deliver supplies to Wal-mart, Marks & Spencer, Carrefour, Tesco, JC Penny, H&M, Gap?eat meat, how much oil and butter they consume, how much rice, what quality, how much coffee and beverages they drink, how much they spend on medicine and health, on their childrens education, on holidays, and all other personal and familial needs. I would also like to know how much they contribute, both directly and indirectly, to the election funds of political parties.
At her first court hearing, Mishu had stood in the dock and had asked, `Am I a common criminal that I should have to be handcuffed like this?’
No Mishu, neither you, nor other labour leaders, nor workers demonstrating for living wages, none of you are criminals. Those denying living wages to garment workers, are. It is they who are criminals. Your struggles serve to expose them for what they really are underneath their smooth and slick smiles, their expensive clothes. Petty, miserable, brutal. The real criminals.

My heart was heavy on Victory Day.
On Dec 12, four people, including a rickshaw driver aged 35, were killed in Chittagong EPZ as garment workers clashed with police because the new wage structure when implemented, meant getting lesser wages. According to news reports, the management of South Korean-owned Youngone suddenly shut down all its units after workers protested the withdrawal of their Tk 250 lunch allowance. When 10,000 workers turned up for work on Sunday morning, they found the factory closed down for an indefinite period. Demonstrations and picketing took a violent turn when police opened fire with live bullets (600 rounds) and tear gas shells (150 canisters). Workers retaliated with brickbats, sticks and stones. The Deputy Commissioner (Port) in Chittagong claimed, rickshaw-driver Ariful Islam had died from a hurled brick; his employer however said, he had been shot dead. Eight injured persons had bullet wounds. Police filed cases against an unidentified 33,000.
Less than two days later, in the early hours of December 14, a contingent of 12 or so claiming to belong to the Detective Branch, all in plainclothes except 1, turned up at the Kola Bagan house of Moshrefa Mishu, president of Garments Workers Unity Forum. When her sister Jebunnessa wanted to see a warrant, they threatened to arrest her too. Mishu was only allowed to change her clothes, she had to leave her medicine behind: for asthma, and for a severe spinal injury from an attack on her life several years ago. She was produced in court after midday and remanded for 2 days on charges of inciting vandalism during worker unrest in Kuril (Kafrul, Dhaka) in June this year. At the end of 2 days, she was remanded for yet another day. She had Jamaat links, they alleged. It needed further investigation, they said.
Mishu? Remanded? For inciting vandalism? As we sat stunned with this news on the 14th, the gods played a cruel joke.
On December 14, a fire broke out in Ha-Meem Group’s sportswear factory in Ashulia, Dhaka. Fire spread to the dining area on the 10th floor where about 150 workers were having lunch. “Emergency exits were closed,” said Abdul Kader to Asia Times Online. To escape from the rapidly-spreading flames, 50-60 workers jumped off the tenth floor. Many, to their death.
Ha-Meem management says 23 died; hospital and clinic sources report 26 deaths, some newspapers report 31 but workers insist many more as relatives throng at the factory gates in search of missing family members. After being closed for two days to mourn the deaths of workers, it was re-opened on Friday, the weekly holiday, but also, a public holiday due to Ashura. The next day, a large chunk of concrete fell on the floor of the 8th floor, as the devastation caused by the fire was being repaired. Workers rushed out of the building fearing for their lives. At least 25 were injured.

According to the Fire Service and Civil Defence Department, fires broke out in 213 factories between 2006 and 2009. The number of deaths? 414. These figures include the Spectrum/Shahriyar Sweater factory collapse in 2005, when 64 workers were killed and 80 were injured, 54 seriously. It excludes the deaths caused by fire which broke out this February at Garib & Garib Sweater factory, built on marshy land. 21 workers’ died, another 50 were injured.
According to international groups dedicated to improving the working conditions of workers worldwide, the Bangladeshi garment industry is “notorious” for its bad safety record. Most of the deaths and injuries are entirely “preventable.” According to the Clean Clothes Campaign, a global network of labour and women’s rights organisations, Bangladeshi factory owners “blatantly violate building code and health and safety regulations”; the government (regardless of which party is in power) “fails to enforce these regulations.” At Garib & Garib, fire rapidly spread because the floors were filled with inflammable materials such as wool threads, workers who were cut off by the fire could not escape because emergency exits were locked; material piled-high blocked the stairways. Fire brigade officials said, the factory’s fire-fighting equipment was “virtually useless.”
The joke played by the gods was undoubtedly cruel since it snatched away many lives? 23? 26? 31? more??but it pointed fingers as well.
Has any factory owner ever been picked up by the police, remanded, arrested, and charged because of factory fires? Not that I know of. The officer-in-charge of Ashulia thana says, (only) a general diary has been lodged in connection with the fire at Ha-Meem. Interestingly, Ha-Meem Group’s managing director AK Azad is also the president of the Federation of Bangladesh Chambers of Commerce and Industry (FBCCI).
Just as factory fires are not properly investigated, neither are acts of vandalism. One hears ministers, high party officials, intellectuals-serving-party-interests and experts claim every so often that these are caused by `outsiders.’ But these `outside forces’ are never specified. Despite turf wars over waste cloth from the garment industry (jhoot baybsha). Despite cutthroat competition among some of the owners themselves. Despite rumours that some were initiated to claim insurance. Despite competition between exporting nations, too. It is much easier to demonise Mishu, other garment leaders, and workers in general. After all, who knows what Pandora’s box a genuine investigation will open?
Nearly three and half million work in the RMG sector, mostly women. It accounts for 80% of annual export earnings and makes clothes for major Western brands such as Wal-mart, Marks & Spencer, Carrefour, Tesco, JC Penny. In 2006, the monthly minimum wage was fixed at Tk 1,662 (US$23). Since then, despite spiralling prices and soaring living costs, garment workers had received no pay rises, although Bangladeshi labour law dictates that wages should be reassessed and adjusted every three years. The new minimum wage approved in August this year?at 3,000 taka ($43) it fell far short of labour union demands of 5,000 taka ($72)?was grudgingly agreed upon by owners, unwilling to give Eid bonuses according to the new wage structure. Last year, the president of Bangladesh Garment Manufacturers and Exporters Association (BGMEA) had demanded a 30 billion taka subsidy ($428 million) from the government’s stimulus package fund to pay workers wages and bonuses. It was outrageous even by AL government’s standards which, as Shahidullah Chowdhury, president, Bangladesh Trade Union Centre, points out, is “essentially biased” towards protecting and promoting the interests of the rich. The finance minister rejected it outright, leaving the BGMEA mumbling that it was an “error.”
Clashes occurred in November this year because many factories had either failed to implement what had been agreed upon, or had implemented it through applying a grading system which effectively “lessened” the pay of many workers.
As I write, I remember Mishu telling me many years ago, I seem to be spending my life fighting for basic rights, those that are declared in the ILO Convention, are laid down in Bangladesh law. Struggling for more fundamental changes, for the re-distribution of wealth and resources, is a far cry. These basic rights should be enforced by the government, she said. In its own interest.
Was muktijuddho not fought for ensuring economic and social justice? For changing the lives of the greater majority for the better? The Awami League and its intelligentsia would have us believe that it was fought only against religious forces who had collaborated with the Pakistan government and its army, a sore enough point for the nation given post-1971 events. Given that the war criminals of 1971 were politically restored, given that Jamaat-e-Islami became BNP’s electoral allies, became a part of the government. But the trial of war criminals is a national issue, it should not be subjugated to serve the narrow interests of the Awami League. Nor should we allow it to be capitalised upon by imperial forces, to draw us into the ever-expanding `war on terror.’

The adoption and pursuit of neo-liberal policies have led to the emergence of new forms of femininities in Bangladesh. Women pose, strut down the aisle. The closed-off, vacant look they are trained to wear makes it difficult to tell whether they know that the garments they parade are soaked in sweat. In tears. And, in blood. Of other women.

URGENT. Release Garment Workers Leader Moshrefa Mishu immediately, arrested on fabricated charges

Officers of the Detective Branch of police picked up labour leader Moshrefa Mishu, president of Garments Workers Unity Forum, from her home in Dhaka a little after midnight.
According to news reports, her sister Jebunnesa Jebu who lives with Mishu, said she was was taken away to the Detective Branch Headquarters for interrogation around 12:45am,?14 December 2010.
About a dozen police officers, in plain clothes except one, carried out the raid on the labour leader’s Bhuter Gali home in Kalabagan.?The officers did not show any arrest warrant, said Jebunnesa, nor did they explain why she was being led away.?After having initially denied her arrest, she has now been charged by the police with having instigated garment workers to go `berserk’ at Kuril.
The arrest occurred three days after thousands of Bangladeshi garment workers picketed factories in Dhaka demanding the implementation of a new minimum wage that should have come into effect last month. Demonstrations and picketing spread to the Chittagong EPZ, three people were killed and 225 injured in police clashes in Chittagong on Sunday. Police have arrested 33?people and?lodged three separate cases against about 30,000 unknown people for Sunday’s deadly violence in the port city.
More than three million people, most of them women, work in Bangladesh’s garment factories, which make clothes for major Western brands, this includes Wal-Mart, Marks & Spencer and Carrefour.
State repression (killing, baton charges, firing tear gas, filing cases) upon workers who are fighting for implementation of wages officially agreed upon, makes a mockery of the democratic principles?that Sheikh Hasina-led Awami League?government claims to uphold. It is a matter of urgent concern that the police should release Moshrefa Mishu immmediately. The government should also release all garment workers who have been arrested, lift the cases against large numbers of people which is aimed at intimidating workers who are fighting for their rights, and should force factory owners to pay wages agreed upon earlier.

Update:
BREAKING NEWS: Moshrefa Mishu was produced before the Chief Metropolitan Magistrate (CMM) Court after midday today. The court granted 2 days remand.
We would like to remind everyone that she was arrested unlawfully, i.e., without any warrant; from what we have learnt since from her sister Jebunnessa Jebu, despite repeatedly being asked the reason for their presence, or whether they had a warrant, members of the force responded by threatening to arrest Moshrefa Mishu if she persisted in asking to see a warrant.
She was only allowed to change her nightclothes and to put on a sari but was not allowed to take her medication for asthma and severe spinal pains, caused by an attempt on her life several years ago.
Moshrefa Mishu has been receiving threatening calls over telephone warning her to stop fighting for the rights of workers in the garments sector.

Today, 9th December 2010, is Begum Rokeya Day
We have come a long way since Begum Rokeya chaired the Bengal Women’s Education Conference in 1926, in Kolkata (Calcutta).
She began by speaking in her characteristically humorous and self-deprecating manner, although I am grateful to you for the respect that you have expressed towards me by inviting me to preside over the conference, I am forced to say that you have not made the right choice.

I have been locked up in the socially oppressive iron casket of `porda’ for all my life. I have not been able to mix very well with people, as a matter of fact, I do not even know what is expected of a chairperson, I do not know if one is supposed to laugh, or to cry.
With these opening words, Begum Rokeya launched into an incisive critique?and that too, characteristically?of the state of Muslim women’s education in colonial, and undivided, Bengal.
But before doing this, while acknowledging with all humility that the women in her audience were far better-educated than her own self, that the gathering consisted of “learned, graduate women,” she gently pointed out that her services to literature and society for the last 20-21 years, her experience of running the Sakhawat Memorial Girls School for 16 years, had provided her with the courage to speak in front of such a distinguished assembly.
To speak about women’s education means that one must necessarily talk about the social situation. This cannot be avoided, it is inevitable. And to talk about the social situation means that one must cast glances at the neglectful, indifferent and miserly behaviour which our Muslim brothers have shown towards us. That too, cannot be avoided, that too, is inevitable. We have a proverb, she said, `to speak of one’s misfortune is to cast aspersion on others.’ This, thereby, impels us to face the question, how can we give Muslim girls a good education? How do we educate them well?
Men have deceived women through the ages, said Rokeya, and women have silently suffered. Recently, however, `Sri Krishna’ has bestowed kindness on our Hindu sisters, this is why one notices signs of awakening among different Hindu communities. Women in Madras have advanced the furthest, and we now hear that a woman has been elected the deputy president of the Madras Legislative Council. We also hear that a woman has become a barrister in Rangoon. And, of course, lady Barrister Miss Ghorabji is already well-known. But what does one have to say about Muslim women, except that they continue to live in the darkness in which they have been living, for ever so long?
You will not find even 1 literate girl among 200 girls, that is the situation of Muslim women’s education. You will not find a truly educated Muslim woman, probably not even 1 in 10,000, that is the situation of Muslim women’s education; and mind you, nearly 3 crore people live in Bengal. The education department wrote me a letter last January, they needed, quickly, they said, the names and addresses of all Muslim women graduates in Bengal. But I couldn’t give them any other name than the only woman graduate we have, plus that of Agha Moidul Islam shaheb’s daughter but since Agha shaheb is not a resident of Bengal, this means that there is only 1 (Muslim) woman graduate in a population of 3 crores!!
A little later, Rokeya tucks in these lines, and this is what makes Begum Rokeya great, it is a greatness that rests on cutting-edge intellectual sharpness, is politically astute, confronts structures of power and privilege while simultaneously engaging with them, maintains a critical distance even as she works from within these institutions, and it is this, I insist, that makes her voice distinct from the `imploring’ voices which 19th-20th century Bengali women writers often adopted, or felt forced to adopt . Rokeya says, “Just as the kind-hearted British government is unable to tolerate the aspirations of the Indians?I remember, Mr Morley said 21 years ago, If they cry for the moon, it doesn’t mean we have to give in to their wishes?just as our non-Muslim neighbours generally cannot tolerate the demands of the Muslims, Muslim men too, in exactly the same manner, cannot accept the fact that women desire their advancement.” In other words, there is nothing natural about the “neglectful, indifferent and miserly behaviour” of Muslim men, they are not accidental, nor incidental for that matter, such behaviour is inextricably linked to social power and privilege, ones that are fundamental, deeply-rooted. Ones that are, in the final analysis, political, marking as they do, the boundaries of inclusion and exclusion into assemblies of the “learned” and the “educated.” Marking those who have power. Those who withhold power.
We have shown respect towards you, Begum Rokeya. The first women’s hall of residence in Dhaka university (in its early years, known as the `Oxford of the east’) was named Rokeya Hall (1964) . One of the busiest roads in Dhaka city, close to the parliament building, is named Rokeya Shoroni. The government awards Rokeya Padak each year to women who have struggled hard to contribute to the betterment of women’s lot, the government girls college in Rangpur is named Begum Rokeya College (1963), and the newly-built public university in Rangpur (2008)?the first public university in the northern region?was re-named Begum Rokeya university to honor the “legendary woman scholar who pioneered and promoted female education in Indo-Pak-Bangla subcontinent.” Social and cultural organisations too, revere you, for all that you fought and struggled for, in a life that was abruptly extinguished at 53, and of course, for the women’s movement, you are the lamp that lights our heart. Bangladesh Mohila Porishod named its safe haven for women, Rokeya Shodon, in your honor. The Department of Women and Gender Studies, Dhaka University holds Begum Rokeya Memorial Lectures on December 9th every year, and we are indebted to Rokeya Memorial Foundation, at whose initiative, Rokeya Dibosh is observed every December 9th, since 1986, the day that you were born, and the day that you left us. It would be amiss if I were not to mention our indebtedness to Abdul Kadir for having immemorialised your writings through editing the collected volume of your work Rokeya Rachanavali, (Bangla Academy, 1973). And, to Roushan Jahan too, for having edited and translated your scathing indictment of porda, Inside Seclusion: The Avarodhbasini of Rokeya Sakhawat Hossain (Women for Women, 1981), thereby making some of your writings available to an English-reading audience.
And since 1994, Rokeya Dibosh is observed by the government, floral wreaths are placed at your birthplace in Pairaband village in Rangpur; scores of organisations take part in discussions and cultural programmes, all over the nation, all in your honor. It is customary too, for the president and the prime minister, and the leader of the opposition, to send messages to the nation on the occasion of Rokeya Dibosh to remind us of you, of all that you fought for. In her message last year, Sheikh Hasina reminded us that if you had not shown us the path, women in present-day Bangladesh would not be working in offices, courts, mills and factories, in fields and farms, and in trade and commerce.?While Khaleda Zia, as prime minister, reminded us several years earlier that we are enjoying the “fruits” of your struggle, that it is because of you that women in Bangladesh have now become judges and barristers, have joined the army, they fly planes and work in nearly all professions by dint of their “own competence and efficiency.” She had added, if not forced to enter national-level politics to uphold the ideals of her husband, the late president Ziaur Rahman, she would have dedicated herself to building up a social movement for the emancipation of women.
But present-day Bangladesh, according to newspaper reports, has registered a nationwide drop in the number of girls attending schools because sexual harassment and violence has horrifically escalated over the last year. Is it possible to talk about the “misfortune” that has befallen them, without “casting aspersions” on others?
On the prime minister?who reminded us in a seemingly self-congratulatory manner when awarding Rokeya Padak last year, that the prime minister, leader of the opposition, deputy leader of the house, home minister, foreign minister, agriculture minister, labour minister, and women and child affairs minister, “are all women”?because the leaders and cadres of her party’s student and youth organisations have allegedly been, in many cases, the offendors. That, to deflect public outrage, the long-discarded notion of `eve-teasing’ was re-introduced, in utter contempt of last year’s High Court verdict which ruled that any kind of physical, mental or sexual harassment?note, not `eve teasing’?of women, girls and children was a criminal offence, that the return of `eve-teasing’ served to dilute, and to de-criminalise these?offences.? That it helped create a culture of impunity which has contributed to an escalation in sexual harassment and violence, as demonstrated by the outrageous rise in figures released on International Day for the Elimination of Violence against Women (November 25).
Is it possible to talk about the misfortunes of our school girls, and also, their guardians, some of whom have been killed while attempting to protect them, without casting aspersions on the leader of the opposition for leading a political party which has been galvanised into action when she was forced to leave her house, who has since preferred to desert the parliament, instead of entering it and demanding answers from the government about what concrete measures are being taking to stem sexual violence. Without casting aspersions on all who are complicit in the conspiracy of silence?sections of the media which continue to report incidents of `eve-teasing.’ Some women’s organisations which are noticeably less vocal now than when Yasmeen of Dinajpur was `eve-teased’ (raped and killed by policemen, an incident which was capitalised upon to bring down the BNP government). Will only a change of regime galvanise them into action? Into calling, for instance, a nationwide boycott of schools by girl students until effective measures have been taken by the government to ensure their safety?
Violence against girls keeps spiralling upwards: on December 4, a 17 year-old college girl in Barguna lost her leg because she spurned an `eve-teaser’ who hacked it (Daily Sun, 5 December) . And yesterday’s newspaper reports that a stalker knifed a 14 year-old madrassa girl because she refused his proposition (New Age, December 8). In both incidents, the girls and their families had lodged complaints with the local thana, but no action had been taken.
Unfortunately, Begum Rokeya, the “neglectful, indifferent and miserly behaviour” towards educating women that you spoke of enfolds us too?we, who are what we are because of you?because we are either too busy eating the fruits of your struggles, or dreaming of future fruits, or choose to remain passive, or to play it safe. You were right to remind us that education is not only about acquiring degrees and certificates, that unless a qualitative change in the state of one’s mind has occurred, we remain murkho, we remain enslaved..
And today Begum Rokeya, we, both men and women of this country, will provide ample evidence of that. Flowery words will escape many a lips, all in your honor.
As you shudder in your grave.

Missing for over 300 days

On 25th November, far away from my motherland, I rang Sandya Eknaligoda to ask her, How are you? Yesterday was the 300th day that her loving husband has been missing. And for all Sri Lankans, one of our best cartoonists, writers, journalists, painters and activists has been missing for 300 days.
Sandya told me that a group of about 60 people met yesterday at the Temple of the Innocents with lotus flowers and oil lamps to do a simple ritual for Prageeth. This little monument in front of the Parliament was commissioned by Chandrika Kumaranathunga Bandaranayake?s government, designed and built by the artist, Jagath Weerasinghe, to remember victims of the late 80s/early 90s Southern insurgency. It had been long neglected, its meaning forgotten. Soldiers, whose job is to protect the coming and going Parliamentarians, had been using it as a place to piss. But friends cleaned it up and made it the place to be together on Prageeth?s 300th day.

My mind has been scrolling through the decades during which Prageeth and I have known each other. These are a few of those moments with my missing friend:
In the years of 60,000 dead, the late 80s and early 90s, Mawatha (The Way) magazine was struggling to make sense of our country?s vortex of insanity. Bahktin, Bukharin, Gramsci, Althusser, Foucault, Derrida, all were being studied as fuel for our political thinking, trawled for a social analysis that might help us understand. It was 1990 and I had cycled into town, Galle in the south of Sri Lanka, to buy vegetables for my Auntie. I secretly bought a copy of Mawatha, rolled it carefully into the Government newspaper and hid it beneath the vegetables in the bottom of my basket because there were checkpoints every 500-1000 meters. Back at Auntie?s, I found a private place to read. This is where I first met Prageeth, in his writings for Mawatha 20 years ago.
The next time was in person in 1992 in Colombo. A group of us, young and middle class, used to meet to discuss politics, culture, democracy, human rights ? everything ? how to make things better, practical steps, what to do about our disastrous country. Prageeth was always present, mostly silent, closely observing.
Later, in 1992-4 we had a movement we called Freedom from Fear, confronting the cycles of violence in our world, against the killings and disappearances, trying to create a properly democratic space. Prageeth drew two portraits that became iconic images. One was of Richard de Zoyza, the popular actor, journalist and TV presenter whose slaughtered body had been found on a beach south of Colombo. Looking pensive, chin resting on his hand, his face, beard, and glasses aligned, Richard?s gaze was focused on the viewer. The other portrait was of Ranjini Thiranagama, the Tamil academic and human rights activist, founder member of the UTHRJ (University Teachers? Human Rights Organisation Jaffna), who had been killed by the Liberation Tigers of Tamil Eelam (LTTE). These pictures became the emblems of our group.
My fourth moment was working together later in the 90s on the Values of Dissent publications for the Civil Rights Movement. Prageeth was designing the covers and layout, creating the visual concept for the series of books we produced.
In 2007, while abroad, I was reading Prageeth?s pieces on the LankaeNews website; sharp insightful writings about the fundamental issues behind the Mahinda Rajapaksa regime, revealing the deeper meanings, the subtexts and hidden agendas.
Later in 2007, the last time we met in person, we talked a lot about education, the future of the next generation, his kids, and the daughter of a friend. As we said goodbye, Prageeth warned that we have to be very careful. ?These people know how to play the game with the world. They themselves were once democratic and human rights activists ? this regime is full of them!?
Now he is abducted, disappeared, missing for 300 days.
There was a first time: a year ago he was abducted and then released because they ?got the wrong person?. This second time they have dragged him into the vortex of Sri Lanka?s nightmare.
I am looking at the photograph of this little 300 Days ceremony. What can I read in it? I see many people with whom I have been involved the whole of my lifetime; people who fight for equal rights, for human rights, against abuses, war and corruption. There are small differences: people have got a bit old, there are fewer of them; many have been killed, exiled or silenced. But those in the photo, their eyes and faces are so bright, strong and energetic. They look like they have the inner strength and energy to fight for even more decades.
Beyond this photograph of people gathered for Prageeth at the Temple of the Innocents, I see in my mind the Sri Lankan Parliament so nearby. Most of the Parliamentarians sitting there, Ruling Party and Opposition, are responsible as perpetrators, colluders, collaborators and beneficiaries of the violence, the arrests, the abductions, disappearances, tortures, wars, corruption and impunity that has cursed post-independence Sri Lanka.
In one of his poems about Hitler?s Germany, Berthold Brecht asked: If you cannot protect your people, why should the sun rise on your country? In Sri Lanka people from all communities are being abducted, disappeared, tortured and killed. It pains me to say that my friend Prageeth is one amongst tens of thousands. There is a famous poem of Martin Niemoeller about those who dared not speak out when others were being taken. In Sri Lanka, whether you speak or not, whether you act or not, they will come for you.

New Delhi, October 31: A mob of about a hundred people arrived at my house at 11 this morning (Sunday October 31st 2010.) They broke through the gate and vandalized property. They shouted slogans against me for my views on Kashmir, and threatened to teach me a lesson.
The OB Vans of NDTV, Times Now and News 24 were already in place ostensibly to cover the event live. TV reports say that the mob consisted largely of members of the BJP?s Mahila Morcha (Women?s wing).
After they left, the police advised us to let them know if in future we saw any OB vans hanging around the neighborhood because they said that was an indication that a mob was on its way. In June this year, after a false report in the papers by Press Trust of India (PTI) two men on motorcycles tried to stone the windows of my home. They too were accompanied by TV cameramen.
What is the nature of the agreement between these sections of the media and mobs and criminals in search of spectacle? Does the media which positions itself at the ?scene? in advance have a guarantee that the attacks and demonstrations will be non-violent? What happens if there is criminal trespass (as there was today) or even something worse? Does the media then become accessory to the crime?
This question is important, given that some TV channels and newspapers are in the process of brazenly inciting mob anger against me.
In the race for sensationalism the line between reporting news and manufacturing news is becoming blurred. So what if a few people have to be sacrificed at the altar of TRP ratings?
The Government has indicated that it does not intend to go ahead with the charges of sedition against me and the other speakers at a recent seminar on Azadi for Kashmir. So the task of punishing me for my views seems to have been taken on by right wing storm troopers.
The Bajrang Dal and the RSS have openly announced that they are going to ?fix? me with all the means at their disposal including filing cases against me all over the country. The whole country has seen what they are capable of doing, the extent to which they are capable of going.
So, while the Government is showing a degree of maturity, are sections of the media and the infrastructure of democracy being rented out to those who believe in mob justice?
I can understand that the BJP’s Mahila Morcha is using me to distract attention from the senior RSS activist Indresh Kumar who has recently been named in the CBI charge-sheet for the bomb blast in Ajmer Sharif in which several people were killed and many injured.
But why are sections of the mainstream media doing the same?
Is a writer with unpopular views more dangerous than a suspect in a bomb blast? Or is it a question of ideological alignment?

The much talked about August 9 Time magazine cover, unabashed in its aim to shore up support for the war effort in Afghanistan, has left many still shaking their heads in disbelief at such brazen exploitation of a woman?s suffering. It?s not the first time the plight of Afghan women has been used to manipulate public opinion. It?s a narrative we have become so accustomed to since the 2001 invasion, that many of my most intelligent female friends did not recognize it for the subversive emotional blackmail that it is. More important, they said, was the attention it brought to women?s issues. Well, let us talk about those issues in earnest, then.
The picture, by South African photographer Jodi Bieber, shows an 18-year old woman by the name of Bibi Aisha. Her story is tragic, and all too common in places like Afghanistan. Married off at a young age, she was beaten regularly by her in-laws and forced to sleep in the stable among the animals. Aisha decided to flee, but women wandering around on their own don?t go unnoticed in Afghanistan, and before long, she ended up in a prison in Kandahar. While not officially a crime, running away is often treated as such and can receive hefty sentences; in this case three years. But her father found her, and took her back to her in-laws. Her punishment for disgracing the family was decreed: her husband, A Taliban?according to some accounts, should cut off her nose and ears. She was left for dead in the mountains of Oruzgan. As a testament to her fighter spirit, she managed to drag herself to her father?s house, who took her to a US Army hospital where she was cared for until they turned her over to a shelter in Kabul. This was 2009.
After an article about her ordeal appeared in the?Daily Beast in December of last year, the Grossman Burn Foundation in California offered to perform reconstructive surgery on her this past spring, long before her face appeared on Time?s cover. She arrived in the US to begin treatment last week, just as her portrait appeared on newsstands amid the media frenzy surrounding the recent release of some 76,900 classified Afghan war documents. Perfect timing.
Aisha?s story will have a happy ending. America will have done right by her. She will get her nose back and hopefully go on to live a perfectly normal life far away from her abusers. It?s a heart-warming story. But what about the remaining 15 million Afghan women, nearly 90% of whom it is estimated suffer from some form of domestic abuse, and moreover, what does this have to do with America?s war?
Most people will never read the accompanying?article in Time magazine. They will only see the disturbing gaze of a mutilated woman and the message scrawled beneath it ?What Happens If We Leave Afghanistan,? question mark excluded. Most will never examine the mechanisms within them that bring about the deep emotional response. Subliminal advertisers know all too well that a powerful image can make a target audience ignore the caption, all the while absorbing it subconsciously, reducing them to zombie-like consumers ready to do whatever the ad tells them to: buy this car, try this diet, sell your house, dye your hair, get a new phone, support our war. Using emotional triggers like scantily clad women in ads that sell anything from watches to hair-loss treatment, have proven effective time and time again. A strong image can be a thousand times more powerful than the words that accompany it, but words can manipulate the message of an image in far more virulent ways. The photograph alone is subject to interpretation. But in this case, the two combined, we are being sent a clear message that tells us this is what will happen?if we leave Afghanistan. Who among us wants this to happen to another Afghan woman? Guilt is the precise emotional response that makes us suddenly feel that being against the war is somehow a travesty.
Setting aside the obvious (that this is what is happening?now,?today, on?our watch) how can Time editor Rick Stengel be so sure of the future? ?I think we answer questions. I don?t think we ask them,? Mr. Stengel said in an interview with Katie Couric when she pointed out the missing question mark at the end of the headline. It?s one thing to draw conclusions about questions that can actually be answered, like is there undeniable evidence that Bernie Madoff cheated lots of people out of money? It is another to predict the future of a foreign country at war, something analysts, historians and military advisors have been unable to do since time immemorial.
Mr. Stengel?explained his editorial choice in the first pages of the magazine as follows: ?What you see in these pictures and our story is something that you cannot find in those 91,000 documents,? he said, referring to the recent release of leaked classified papers titledThe Afghan War Diaries by whistleblower website Wikileaks. The White House has been struggling desperately to convince the public that we can?t leave Afghanistan amid the fallout following the leak, a trove of documents that reveal the true horrors of the war campaign on the ground, and it seems Mr. Stengel decided to play steward to the Pentagon and help sway public opinion.
In his chosen message, two points of absurdity emerge: when in the history of mankind has a war ever been fought in the name of women?s rights, and how can one justify the murder and mutilation of thousands of innocents in the name of eradicating domestic abuse, never mind the fact that the Pentagon has no vested interest in the said cause. Countries don?t spend billions of dollars to mobilize troops to liberate women from the chains of institutionalized misogyny.
Why then, should we believe that saving the Aishas of Afghanistan is a just cause for war? It?s a narrative we have heard periodically for nine years, though never when it stood to benefit the women in question. In the lead up to the war, we were shown images of Afghan women being beaten and executed by the Taliban at Kabul?s infamous soccer stadium. Stories in the press abounded about the terrible living conditions of women under the Taliban, pulling on the heart strings of the typically more pacifist female demographic, and yet, nary a member of congress brought the matter to the floor prior to 2001. If it was really a just cause for mounting a full-scale invasion, it begs the most conspicuous question: why have we not done so in other parts of the world where our sisters are suffering too?
It?s the same ludicrous line we?ve been fed about wars in the name of democracy and freedom. We went in to Iraq to liberate the people from a terrible dictator. What we ended up doing is ?liberating? well over 4 million people of life, limb, or home, ripping the country asunder, ushering in extremist factions that made some of the once secular nation?s women dress in the code of Hijab or wear a Burqa for the first time in their lives.
So why have we heard this line about the women every time proponents of the war seem to be dwindling? Because it works. Look no further for evidence than a recently leaked?CIA document in March of this year, drawn up after the Dutch decided to pull out of the war. Amid fears that Germany and France, who supply the third and fourth largest contingents to Afghanistan, might follow suit, it suggests pushing stories about abused Afghan women to drum up support for the war:

Afghan women could serve as ideal messengers in humanizing the ISAF [International Security Assistance Force] role in combating the Taliban because of women?s ability to speak personally and credibly about their experiences under the Taliban, their aspirations for the future, and their fears of a Taliban victory. Outreach initiatives that create media opportunities for Afghan women to share their stories with French, German, and other European women could help to overcome pervasive scepticism among women in Western Europe toward the ISAF mission.

But women in Afghanistan suffer abuse at the hands of Talibs and non-Talibs alike. It?s a social problem, not a Taliban problem. Of course, ousting the Taliban did women a favour in many regards. They regained suffrage, for one. Yes, today women nearly fill the 25% quota for parliamentary seats, and education is no longer officially forbidden. But how many women really benefit from the new constitution? What is written on paper is rarely applied in practice for the vast majority of women, particularly those living in rural areas, which represent about 77% of the population.
According to a?recent survey by the UN Development Fund for Women (UNIFEM), ?more than 87 percent of all women suffer from domestic abuse, making the country one of the most dangerous places in the world to be a woman.? That is today. Are we to believe that 100% of women were being abused under the Taliban, or will be if they return to power? Is that meagre 13% of violence-free women really the result of the ISAF mission?
In 2007 I did a?story on Afghan women who self-immolate. They are so desperate that, one day, something compels them to douse themselves with petrol and strike a match. I listened to their stories with unease. They were beaten, raped, used as prostitutes, molested and enslaved; all by husbands, fathers, cousins, uncles, brothers, or in-laws. Not one of them was from Taliban territory. Though it?s impossible to get a real sense of the numbers, most agree that the phenomenon is on the rise, and yet, we are meant to believe that the war effort is making progress on the front of women?s rights.
Oppression and brutality against women are not endemic to the Taliban alone in Afghanistan. Last year, President Karzai, in a bid to gain votes from the country?s Shia minority (roughly 19%) passed a controversial new law curtailing women?s rights. The Shiite Personal Status Law (SPSL), allows a man to deny his wife food if she does not submit to his sexual will, gives custody of children to fathers and grandfathers, and requires a woman to get permission from her family to work or to travel outside the home without a male escort. ?It also, in effect, enables a rapist to avoid prosecution by paying ?blood money?,? says Human Rights Watch.
It?s worth noting that the Taliban are Sunni, not Shia, and that the US-backed president has enacted a law for the non-Taliban sector of society, rolling back rights for women that were written into the constitution. Before the elections, the?Times Online reported that ?the United States and Britain [were] opposed to any strong public protest [against the law] because they fear[ed] that speaking out could disrupt [the] election.?? The bill was pushed through parliament in February of 2009 and came into effect in July of last year. Afghan women fumed, while US and UK leaders stood by, and where was Time?s cover advocating for women?s rights then? Here are the covers they ran in February 2009.

Central to the debate about the message the Time cover sends, is the question are we really making progress for women ? and if so, why should we believe that a good reason to continue fighting? While many people were moved by the cover, some things just don?t add up. After nine years of war, the public has grown wary of these kinds of media stunts. We are not so dumb anymore. The Bush years are over. Challenging our leaders is no longer tantamount to a capital offence. Not ?supporting the troops? is no longer suggestive of treason, since so many of them are returning home to join the growing anti-war movement. Support for the war has plunged to an all-time low (36%). Too many US soldiers have committed suicide or come home suffering from Post Traumatic Stress Disorder (PTSD). People are starting to feel uncomfortable about the number of Afghan civilian casualties, which sadly should have been an issue long ago, but what the Wikileaks documents show us is that the army has been cooking the numbers. All those deaths of ?enemy combatants? were in reality far too often civilians. Such facts Americans are not happy to learn. The truth is coming out, though the editors of Time, like the Pentagon, obviously want to deflect our attention from it by shoving our faces in another gruesome reality that somehow makes even the staunchest pacifist wonder if maybe we?should soldier on.
In my discussions with friends about the cover, I was amazed how many educated, sharp women couldn?t see how they were being manipulated. Many felt it was much more important to shed light on the plight of women, and missed the absurdity of the message attached to it. Some of them were Iranian expats, for whom the subject of women?s rights is all too close to home. But then I asked, what if Time magazine were to run a cover like this one?

Do you look away from images of real-life horror, or look closer? A series of shocking photographs from Somalia asks disturbing questions about the ethics of bearing witness

“To catch a death actually happening and embalm it for all time is something only cameras can do,” writes Susan Sontag in Regarding the Pain of Others, “and pictures taken out in the field of the moment of (or just before) death are among the most celebrated and often reproduced of war photographs.”
Sontag goes on to describe the context in which Eddie Adams took what was arguably the most shocking image of the Vietnam war: the moment in which a South Vietnamese police officer executes a Vietcong suspect by shooting him point-blank in the head. She points out that the picture was both authentic and staged ? “by General Loan, who had led the prisoner, hands tied behind his back, out to the street where journalists had gathered. He would not have carried out the summary execution there had they not been available to witness it”. Wearily, Sontag concludes that “one can gaze at these faces for a long time and not come to the end of the mystery, and the indecency, of such co-spectatorship”.
I was reminded of that final quotation when, a few weeks ago, I navigated the winner’s gallery of the World Press Photo of the Year website. There, amidst the many dramatic images of conflict, death and destruction, was a series by an Associated Press photographer, Farah Abdl Warsameh, entitled Stoned to Death, Somalia, 13 December. The four images are shocking in a way that even the most graphic war reportage seldom is any more. The first shows the victim being buried up to his neck in earth. The second shows a group of men, their faces concealed by headscarves, raining rocks down on his head. The third shows his bloodied torso being dragged out of the soil. The last shows the men hurling large rocks at his prone and lifeless body to finish off their gruesome ritual. There are no captions; we are left to guess the context.
One’s immediate instinct on coming upon the photographs is to recoil in horror, which is what almost everyone I showed them to did. A colleague described them as “a kind of pornography of suffering”. (The Sunday Times ran the series last week in their Spectrum section devoted to the World Press awards. Many readers were outraged and appalled.)
Last week, in a blogpost for Foto8 magazine, the veteran picture editor, Colin Jacobson, wrote that “the rather disgusting pictures ? raised some interesting ethical matters”, which is one ? somewhat understated ? way of putting it. More problematically, Jacobson said that “obviously there was collaboration between the photographer and those carrying out this gruesome death sentence”. Perhaps. But what kind of collaboration? Unlike the shooting of the Vietcong suspect, the dreadful execution of the Somalian man would seemingly have gone ahead at that time had the photographer not been present. (Other images from the series, not included in the World Press selection, show an audience of villagers who had gathered to witness the execution.) On that level, the photographer did not collaborate with the killers, though he almost certainly gained permission from someone to shoot the stoning. He also shot every stage of the killing in all its protracted and torturous barbarity. What it takes to do that, and at what personal cost, only he can say.
Images as extreme as these beg so many questions about the morality of reportage. Did the photographer, one wonders, have any communication with the victim in the time leading up to the event? Would our reaction to the photographs be different if we knew that the condemned man granted the photographer permission to bear witness to his dreadful death? Would it be different if we knew that the photographer risked his own life to travel though strife-torn Somalia to bear witness, which, as one of the respondents to Jacobson’s blog points out, was probably the case. Does such extremity diminish us or enlighten us? Or simply shock us into a kind of impassioned helplessness?
Part of the complex power of these photographs comes from what Sontag calls the “provocation” inherent in all images of real suffering.
